Aquatic Allies –

Terms & Conditions, Liability Waiver & Participant Agreement

By registering for, paying for, accessing online learning for, attending, or participating in any Aquatic Allies course, the participant acknowledges that they have read, understood, and agree to the following terms and conditions:

1. Registration & Enrollment

  • Registration and payment reserve a seat in the selected course only.

  • Registration does not guarantee certification.

  • Participants are responsible for ensuring all registration information provided is accurate and complete.

  • Submission of this registration form constitutes acceptance of all Aquatic Allies policies, procedures, waivers, and terms.

2. Certification Requirements

Certification is contingent upon successful completion of all applicable course requirements, including but not limited to:

  • Meeting all published prerequisites.

  • Completing all required online learning assignments prior to class.

  • Attending all scheduled course sessions.

  • Demonstrating required practical skills.

  • Successfully completing written and practical examinations.

  • Maintaining professional and safe conduct throughout the course.

Failure to meet any certification requirement may result in unsuccessful course completion and/or denial of certification.

3. Course Prerequisites

  • Participants are solely responsible for verifying that they meet all course prerequisites before registering.

  • Aquatic Allies reserves the right to request proof of prerequisite certifications at any time.

  • Participants who fail to meet prerequisites may be removed from the course.

  • Failure to meet prerequisites shall not constitute grounds for a refund.

4. Payment Policy

  • Full payment is required to reserve a seat unless otherwise approved by Aquatic Allies.

  • Registration fees cover instruction, course administration, materials, and reserved class space.

  • Payment guarantees entry into the course but does not guarantee successful completion or certification.

5. Cancellation, Refund & Transfer Policy

  • Cancellations more than 72 hours before the course may be eligible for a refund less applicable processing fees.

  • Cancellations within 72 hours of the course start date may be subject to administrative fees.

  • No refunds will be issued once a course has started.

  • Transfers and reschedules are subject to availability and may incur administrative fees.

  • Courses canceled by Aquatic Allies due to low enrollment, instructor availability, facility issues, weather, or other unforeseen circumstances may be rescheduled or refunded at Aquatic Allies' discretion.

6. Assumption of Risk

Participants understand that safety training courses may involve:

  • Physical activity.

  • Water-based activities.

  • Rescue techniques.

  • CPR and first aid practice.

  • Lifting, carrying, and repetitive movements.

  • Extended periods of standing, swimming, or physical exertion.

Participants voluntarily assume all risks associated with participation in the course.

7. Medical Conditions & Emergency Authorization

  • Participants certify that they are physically and mentally capable of participating in the course.

  • Any injuries, medical conditions, disabilities, limitations, medications, or accommodations that may affect participation must be disclosed prior to the course.

  • In the event of a medical emergency, participants authorize Aquatic Allies staff to obtain emergency medical assistance when necessary.

  • Any costs associated with medical treatment remain the sole responsibility of the participant.

8. Release of Liability

To the fullest extent permitted by law, participants agree to release, waive, discharge, and hold harmless:

  • Aquatic Allies.

  • Its officers, directors, employees, volunteers, and contractors.

  • Course instructors and instructor trainers.

  • Facility owners and partners.

  • Affiliated organizations and representatives.

From any claims, liabilities, injuries, damages, losses, expenses, or causes of action arising from participation in the course.

9. Participant Code of Conduct

Participants agree to:

  • Arrive on time and prepared for class.

  • Follow all instructor directions.

  • Treat instructors, staff, participants, and facilities respectfully.

  • Conduct themselves professionally and safely.

  • Refrain from disruptive, threatening, dishonest, or unsafe behavior.

Aquatic Allies reserves the right to remove any participant from a course without refund for violations of this policy.

10. Multimedia Release

Participants grant Aquatic Allies permission to:

  • Photograph course activities.

  • Record video and audio during training.

  • Use images and recordings for educational, promotional, marketing, website, print, and social media purposes.

Participants understand that no compensation will be provided for such use.

11. Intellectual Property

  • All manuals, presentations, training materials, lesson plans, videos, handouts, and course content remain the property of Aquatic Allies and/or the applicable certifying organization.

  • Materials may not be copied, distributed, reproduced, modified, or used for commercial purposes without written permission.

12. Confidentiality

Participants agree to:

  • Respect the privacy of fellow participants.

  • Maintain the confidentiality of any sensitive information shared during training.

  • Not distribute proprietary course materials without authorization.

Aquatic Allies will maintain participant information in accordance with applicable laws and organizational policies.

13. Force Majeure

Aquatic Allies shall not be responsible for delays, interruptions, cancellations, or modifications resulting from:

  • Severe weather.

  • Facility closures.

  • Public health emergencies.

  • Government actions or mandates.

  • Labor disputes.

  • Natural disasters.

  • Other circumstances beyond reasonable control.

14. Severability

  • If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Agreement & Acknowledgment

By submitting this registration form, making payment, accessing online learning, attending class, or participating in any Aquatic Allies course activity, the participant acknowledges and agrees that:

  • They have read and understand this agreement in its entirety.

  • They voluntarily accept all terms and conditions.

  • Registration and payment constitute acceptance of this agreement.

  • No additional signature is required for these terms to become effective.

  • Registration and payment reserve a seat in the course only.

  • Certification is not guaranteed and is awarded solely upon successful completion of all course requirements.

This agreement shall be legally binding upon the participant and, where applicable, their parent, guardian, heirs, assigns, and legal representatives.
